Terms of Service

These Terms of Service explain what you can expect from us and what we ask of you when you use our website, purchase our services, or participate in our community. We've written this in plain language on purpose - because you deserve to actually understand what you're agreeing to.

By using our site or purchasing our services, you're agreeing to these terms.

Who we are

Spirit & Whimsy is a creative studio rooted in joy, play, and the deep work of faith formation. We develop original curricula and resources for religious educators and faith communities, host a joyful online community space centered on rest and playfulness, offer monthly virtual gatherings, and provide consulting for congregations and organizations doing the work of multigenerational ministry. We're primarily rooted in the Unitarian Universalist tradition, though our doors are wide open. We're based in Pennsylvania, on the unceded land of the Susquehannock people, and operated by real humans who genuinely care about this work and being in right relationship with our customers, clients, and community members.

Your account

When you create an account with us through our host platform (Podia), you're responsible for keeping your login information secure and your account details accurate and up to date. Please don't share your account with others or use someone else's account without permission.

If something ever seems off with your account - unauthorized access, a security concern, anything like that - let us know right away at info@spiritampwhimsy.com.

Purchases and payments

Payments are processed securely through Stripe. Spirit & Whimsy never sees or stores your payment details directly.

Subscriptions:
Some offerings (such as community memberships) are subscription-based and renew automatically at the end of each billing period. You can cancel your subscription at any time through your account settings - no hidden steps. Cancellations take effect at the end of your current billing period, and we cannot offer prorated refunds for partial periods.

If you have any questions or concerns about a charge, just reach out to us directly at info@spiritampwhimsy.com

Our content

The resources, curriculum, materials, and content available through Spirit & Whimsy are our original work and are protected by copyright. When you purchase or access our content, you're receiving a license to use it for your own personal or congregational use - not to resell, redistribute, or share it commercially without our permission.

We put a lot of heart into what we make and we appreciate you treating it accordingly.

What we ask of you

We're building something rooted in good faith and mutual respect. In using our services, we ask that you:

  • Provide accurate information when creating your account or making purchases

  • Use our content and community spaces with integrity

  • Don't use our platform for anything unlawful, harmful, or that violates others' rights

We reserve the right to end our relationship with anyone who misuses our services, at our discretion.

Age requirements

To create an account and purchase resources through Spirit & Whimsy, you must be at least 16 years of age, in accordance with our host platform's requirements.

S&W Community
To join the S&W Community - our paid subscription community space - you must be at least 18 years of age. Community membership includes access to member profiles and community spaces, and we have made the decision to limit this to adults in order to protect the safety and wellbeing of all involved. This is a firm requirement regardless of parental consent.

Recess
Recess, our monthly virtual gathering series, is open to participants who are 18 years of age or older. This is a firm requirement rooted in participant safety.

As a virtual gathering hosted on Zoom, Spirit & Whimsy cannot background check attendees or provide assurances of safety in direct communications that may occur outside of the facilitated session itself - including private messages initiated through Zoom. We take this limitation seriously and have set an adult-only participation policy accordingly.

We deeply value the leadership and energy of young people in faith communities and UU-adjacent spaces, and we recognize that youth movement leaders are doing vital work. It is our hope to offer youth-specific Recess gatherings in the future, designed with appropriate safeguards for younger participants. If this is something you'd like to be notified about when it becomes available, please reach out to us at info@spiritampwhimsy.com.

If you are under 18 and have questions about our resources or offerings, you're welcome to reach out to us directly at info@spiritampwhimsy.com.

Our platform

Spirit & Whimsy's website, resources, and community are hosted on Podia. By using our services, you're also subject to Podia's own policies, which we encourage you to read:

A few things in Podia's Terms worth knowing: disputes between you and Podia (not Spirit & Whimsy, but Podia the platform) are subject to binding arbitration rather than court proceedings, and there is a 30-day window from account creation to opt out of that clause if you choose. Details are in Section 11 of Podia's Terms of Service linked above.

Availability and changes

We do our best to keep everything running smoothly, but we can't guarantee uninterrupted access to our platform or content — that's partly in Podia's hands, and partly just the nature of the internet. We'll always communicate with you if something significant changes about our offerings.

We may update these Terms from time to time. When we do, we'll let you know clearly. Continued use of our services after an update means you accept with the new terms.

Limitation of liability

Spirit & Whimsy is a small, independently operated business. We stand behind our work and will always try to make things right if something goes wrong. That said, we aren't liable for indirect or consequential damages arising from your use of our services, and our total liability to you won't exceed the amount you paid us in the three months prior to any claim.

Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania.
